Welcome to Studio Rose. By accessing or using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Definitions

  • "Company" refers to Studio Rose, its affiliates, and subsidiaries.

  • "Client" refers to any individual or entity using the services of the Company.

  • "Services" refer to photography, portrait creation, and any related offerings provided by the Company.

2. Acceptance of Terms

By using our Services, you affirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years old.

  • Provide accurate and complete information when requested.

  • Comply with applicable laws and regulations.

4. Services Provided

Studio Rose specializes in bespoke boudoir photography and related artistic services. Details of Services, pricing, and packages are outlined on our website or provided upon consultation.

5. Booking and Payments

  • Deposit: A fully refundable $250 deposit is required to secure a booking.

  • Payment Terms: Full payment is required prior to the final delivery of any artwork.

  • Cancellation Policy:

    • Cancellations must be made at least 5 business days prior to the session date to avoid penalty. Failure to meet this requirement will result in the deposit becoming non-refundable.

    • For rescheduling requests made within 5 business days of the session, the original deposit will be forfeited, and a new deposit will be required.

  • Rescheduling Policy:

    • Rescheduling is permitted without penalty when requested at least 5 business days before the session.

    • Rescheduling more than once will require an additional, non-refundable deposit of the same amount.

6. Intellectual Property

All photographs and artworks created by Studio Rose remain the intellectual property of the Company unless explicitly transferred in writing. Clients are granted a limited license for personal use of delivered artworks.

7. Client Responsibilities

  • Punctuality: Clients must arrive on time for appointments. Late arrivals exceeding the 10-minute grace period may result in reduced session time or the loss of the deposit.

  • Feedback on Proofs: All feedback on proofs must be provided during the ordering session. Requests submitted during this session are considered final.

8. Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for any indirect, incidental, or consequential damages arising from the use of our Services.

9. Dispute Resolution

Any disputes will be resolved in accordance with Ontario law. If a resolution cannot be reached amicably, disputes will be settled through arbitration in Ontario.

10. Privacy and Data Collection

The Company collects and uses personal data in accordance with our Privacy Policy. By using our Services, you consent to the collection and use of data as outlined in our Privacy Policy.

11. Modification of Terms

The Company reserves the right to modify these Terms of Service at any time. Clients will be notified of changes via email or website updates. Continued use of the Services constitutes acceptance of the revised terms.

13. SMS Communication and Consent

Consent to Receive SMS Messages:
By providing your phone number during booking or inquiries, you consent to receive recurring SMS communications from Studio Rose. These messages include:

  • Appointment confirmations and reminders.

  • Updates on artwork proofs or project status.

  • Promotional offers, if opted in.

Opt-In Process:
Consent to receive SMS messages is obtained through the following methods:

  • Website Form: By checking the SMS communication box during booking.

  • Verbal or Written Consent: During consultations or bookings.

  • Text Opt-In: Text START to 647-123-4567.

Opt-Out Process:
You may opt out of receiving SMS messages at any time by replying STOP to any message. Upon opting out, you will no longer receive text messages unless you explicitly opt back in.

Message Frequency and Disclaimer:
You will receive messages related to your services and reminders as needed, typically no more than 2–5 messages per month. Message and data rates may apply.
